Province loses lawsuit to nullify Council proposal

The Supreme Court has given legitimacy to Jeju’s ‘Flea Market Support Ordinance’ following a year-long lawsuit to nullify the notion.

The Supreme Court, on Thursday, ruled against the plaintiff on “nullifying the Jeju province culture market support ordinance” which was filed in March 2017 by the provincial government.

The ordinance was initially proposed by lawmaker Kim Tae-seok(김태석) in December 2016, containing matters needed to nurture and support the province’s culture markets, or flea markets.

The provincial government filed a lawsuit to nullify the proposal, on the basis that the seller regulations could violate the food sanitation act.

원고 패소 판결을 내렸습니다.

이 조례안은
재작년 12월 김태석 의원이 대표 발의한 것으로
도민문화시장 즉, 프리마켓을 육성하고 지원하는데 필요한 사항을 담고 있습니다.

제주도는
조례안의 판매 규정이
식품위생법을 위반할 수 있다는 이유로
무효확인소송을 제기했었습니다.
