2. Supreme Court rules against JDC in land case
Owner wins right to property expropriated in 2007

Expropriated lands in the Yerae resort-type Residential Complex was returned to a landowner for the first time.

The Supreme Court ruled in favor of the plaintiff over Jeju Free International City Development Center (JDC) in the final appeal of the lawsuit on ownership transfer registration.

The court ordered JDC to return 1,600 square meters of expropriated land to Mr. Jin, a current resident of Yerae-dong, Seogwipo City. JDC appropriated the land 12 years ago.

A series of similar lawsuits are expected to follow as this court ruling marks the first case to return expropriated lands to its original owners.

대법, "예래단지 수용 토지 반환"…첫 사례

예래휴양형주거단지 사업으로
강제 수용됐던 땅을 되돌려받은 토지주가 처음으로 나왔습니다.

대법원 제2부는
서귀포시 예래동 주민인 진 모씨가
JDC를 상대로 제기한
소유권 이전 등기 소송에서 최종 원고 승소 판결을 내렸습니다.

이에 따라 진 씨는
2007년 JDC가 강제 수용한
토지 1천 6백 제곱미터를 12년 만에 돌려받게 됐습니다.

강제 수용 토지주 가운데
첫 법원 판결에 따른 반환 사례로
앞으로 토지반환 소송이 줄을 이을 것으로 보입니다.
