Local district court to determine the best interests of the son

The bereaved family of Koh Yu-jeong’s ex-husband has filed for custody of the couple's son. Koh is currently under arrest for allegedly killing her ex-husband and throwing away his dismembered body to get rid of the evidence.

The plaintiff petitioned Jeju District Court for the divestment of Koh's parental rights to her son and to appoint the victim’s younger brother as the child’s legal guardian.

They argued that in light of the alleged murder of her spouse, Koh had forfeited her parental authority.

Under civil law, divestment of parental authority is the deprivation of child custody, such as the right to residence designation and property management until the child reaches 19.

18일 변호인을 통해
아들에 대한 고유정의 친권을 박탈하고
후견인으로 피해자의 남동생을 선임해 달라는 신청서를 접수했습니다.

유족들은 청구서를 통해
자신의 남편이자 아이의 아빠인 피해자를 무참히 살해한 고유정이
친모라는 이유만으로 아이의 친권을 갖는 것은
문제가 있다고 주장했습니다.

한편, 민법상 친권 상실이란 아동에 대한
거소지정권과 재산관리권 등
자녀가 만 19살 성년이 되기 전까지
부모가 갖는 권리를 박탈하는 것을 말합니다.
