2. Siblings wrongfully convicted as North Korean spies Jeju District Court acquits victims for lack of evidence

The Jeju District Court acquitted a brother and sister who had been wrongfully convicted as North Korean spies 51 years ago.

Judge Lee Jang-wook acquitted the 74-year woman surnamed Kim and her brother who had passed away. They were both given a one-year jail term with a suspension of two years in July 1968 for violating the anti-communist law by carrying North Korean propaganda material. They were convicted of violating the anti-communist law, since they had received a fountain pens thought to be made in North Korea from their brother.

However, the court explained that there is no evidence that they received the fountain pens for the benefit of anti-state or communist groups.

간첩이라는 오명을 써야했던 남매가

지난 1968년 7월 유죄 선고를 받은
고 김 모 할아버지와 74살 김 모 할머니 남매에 대한 재심 재판에서 무죄를 선고했습니다.

앞서 이들 남매는 지인에게 선물받은 만년필에
천리마와 조선 청진이라는 글자가 쓰여 있던 점에 미뤄
북한 체제 선전용 물건을 받았다며
반공법 위반 혐의로
징역 1년에 집행유예 2년을 받은 바 있습니다.

재판부는
피고인들이 반국가단체나 공산계열의 이익을 위해
만년필을 받았다는 점을 인정할 증거가 없다며
무죄 이유를 설명했습니다.
