3. Court finds for Hanjin Group in groundwater case
Province rejecting local underground water development deemed ‘unjust’

The court ruled that the provincial government was wrong to reject the Korean Airport Service’s request to use more groundwater from Jeju.

Korean Airport Service under Hanjin group won against the province in both its lawsuit and appeal to revoke the province’s cancellation of the group’s request to modifiy groundwater development and use.

Jeju District Court had previously in favor of the KAC in January.

The province will decide whether to appeal the case after an internal review of the court’s ruling statement.

제주도의 한진 지하수 증산 반려 '부당'

한진그룹의 지하수 증산허가 신청을 반려한
제주도의 처분에 대해
법원이 1심에 이어 항소심에서도 위법하다는
취지의 판결을 내렸습니다.

광주고등법원 제주 제1형사부는
한진그룹 산하 한국공항이 제주도를 상대로 제기한
지하수 개발이용 변경허가신청 반려처분 취소 소송에서
원고 승소 판결했습니다.

앞서 재작년 12월
제주도가 지하수 증산 신청을 반려하자
한진 측이 행정소송을 제기했는데,
올해 1월 1심 재판부는
증산 신청 자체를 반려할 법적 근거가 없다며
한진 측의 손을 들어줬습니다.

제주도는 항소심 판결문을 받아본 뒤
내부 검토를 거쳐 상고 여부를 결정할 계획입니다.
