2. High Court overturns ruling of 'Moon Dae-rim Golf Scandal’
Judge acquits offenders as informant was reliable

Judge Lee Jae-kwon of the Jeju office of the Gwangju High Court overturned the original verdict and acquitted the 55-year-old public official, identified only by his surname Kang, who was given a one-year jail term with a suspension of two years on charges of releasing false information under the Public Official Election Act in his first trial.

In addition, the Judge also dismissed the original verdict and acquitted the 41-year-old secretary, who was indicted on the same charges and given a six-month jail term with a two-year suspension.

The court ruled that the testimony of the informant at the time was reliable and that it cannot be determined whether the offenders purposely released false information.

The two were charged for spreading false information about JDC chairman Moon Dae-lim, who was running against Governor Won Hee-ryong in the last local elections. They had made comments that Moon played golf right after the election.

광주고등법원 제주 제1형사부 이재권 수석부장판사는
공직선거법상 허위사실공표 등의 혐의로
1심에서 징역 1년에 집행유예 2년을 선고 받은
제주도청 공보관 55살 강 모씨에 대한 항소심에서
원심을 파기하고 무죄를 선고했습니다.

또 같은 혐의로 기소돼 징역 6월에 집행유예 2년을 받은
언론비서관 41살 고 모씨에 대해서도 원심을 파기하고
무죄를 함께 선고했습니다.

재판부는 판결문에서
당시 제보자의 진술에 신빙성이 높아
허위사실로 단정할 수 없어 이같이 선고한다고 판시했습니다.

이들은 지난 지방선거 당시
원희룡 후보 캠프의 공보단장과 대변인을 맡으면서
당시 상대 후보였던 문대림후보가
경선 직후 골프를 쳤다는 내용의 논평을 발표해
허위사실 공표 혐의로 고발돼 기소됐었습니다.
