Hong convicted for violating the National Security Law

Hong Je-hwa, who was imprisoned for allegedly praising Kim Il-sung while drinking in 1981, was acquitted in a retrial 38 years after being convicted.

Jeju District Court Chief Judge Roh Hyeon-mi overturned the original verdict and acquitted Hong Je-hwa, who was given a 8-month jail term with a suspension of qualification for a year on charges of violating the National Security Law.

The court explained that the defendant’s confession made during police detention was collected illegally, and thus cannot be considered valid evidence.

Hong died last year suffering from mental retardation after being released from prison.

지난 1981년 술자리에서 김일성을 찬양한 듯한 말을 한 이유로
경찰에 끌려가 징역형을 살았던 고 홍제화씨가
38년만에 재심에서 무죄를 선고받았습니다.

제주지법 제1형사부 노현미 부장판사는
국가보안법 위반 등의 혐의로 기소된 고 홍제화 씨의 재심에서
징역 8개월에 자격정지 1년을 선고한 원심을 파기하고
무죄를 선고했습니다.

재판부는 피고인이 경찰에서 불법구금된 상태에서 자백을 했고,
내용 역시 위법하게 수집된 증거로서 증거능력이 없다고 설명했습니다.

한편 홍 씨는 당시 만기 출소한 후
정신지체 장애를 앓다가 지난해 숨졌습니다.
