Rental car companies file \3B compensation suit

Jeju government's decision to prohibit rental car companies from increasing vehicle inventory before the implementation of an official ordinance has been deemed illegal.

Kang Jae-won, a senior judge in the Jeju District Court's administrative department, ruled in favor of the plaintiff in a lawsuit filed against Jeju City by two rental car companies to cancel new vehicle registration licenses.

The court explained the reason for the ruling, saying that although Jeju City made the decision in accordance with the provincial government, there was no legal basis for the rejection because it was made before the official total rental car system was implemented.

Jeju Star Rental and other rental companies have also filed a 3 billion won compensation suit against the Jeju government with the Seoul Southern District Court.

제주스타렌탈 등 2개 업체가 제주시를 상대로 제기한
자동차신규등록 거부처분 취소 소송에서
원고 승소 판결을 내렸습니다.

재판부는 제주시가 제주도의 요청으로 증차를 거부했지만
렌터카 총량제가 시행되기 전에 이뤄진 것이어서
거부처분을 할 수 있는 법률 근거가 없다며 판결 이유를 설명했습니다.

한편 제주스타렌탈 등은 행정소송 외에도
서울남부지법에 제주시를 상대로 30억원대의 손해배상 청구 소송을 제기한 것으로 알려져 결과가 주목됩니다.
