3. Court makes judgment in lawsuit over Yerae Recreation Complex land ownership
Landowners must burden margin to reclaim land from JDC

A ruling has been made that landowners of the land designated for the Yerae Recreation Complex, a project that is currently abandoned, will have to bear the market margins in order to reclaim the land from JDC, Jeju Free International City Development Center.

Shim Byung-jik, a senior judge at the Jeju District Court, recently ruled in favor of the plaintiff in a lawsuit filed by a landowner against JDC for registration of ownership transfer.

The judge also accepted the lawsuit that the defendant JDC filed against the landowner and ordered that the landowner pay additional 159 million won, which is the margin of increase in the land price. The compensation amount received by the landowner was 99 million won but the land price has increased to 253 million won.

Meanwhile, the landowner has expressed the willingness of filing an appeal.

3. 법원, "예래단지 토지 반환…시세차익은 부담해야"

사업이 좌초된 예례휴양형주거단지 원 토지주들이
JDC로부터 땅을 돌려받으려면 시세차익을 부담해야 한다는
판결이 나왔습니다.

제주지방법원 민사4단독 심병직 부장판사는
토지주 A씨가 JDC를 상대로 제기한
소유권 이전 등기 소송에서 최근 원고 승소 판결했습니다.

이와함께 피고인 JDC가 토지주 A씨를 상대로 제기한
환매대금 증액 청구 소송도 받아들여
A씨가 환매권을 주장한 당시 토지가격 2억5천3백만원에서
보상금 9천9백만원을 제외한 나머지 1억5천9백만원을
JDC에 지불하라고 주문했습니다.

한편 A씨 측은 이번 1심 판결에 불복해
항소하겠다는 뜻을 밝혔습니다
