Court says dismissal of Greenland hospital permit is legitimate
Greenland Group failed to meet opening deadline

Jeju’s court has ruled that the province’s administrative order revoking the license of Greenland International Medical Center, Korea's first for-profit hospital, is legitimate.

Kim Hyun-ryong (김현룡), a senior judge of the Jeju District Court's, rejected a lawsuit filed by Greenland Jeju Healthcare Town against the Jeju government after the hospital's license was revoked.

Even with the legality dispute over Jeju Island's conditional approval, the court said in the ruling that the hospital was obliged to open within three months of the permit's issuance under the medical service act. By refusing to do so, Greenland Group could be legally stripped of its permit.

The court said it will delay its ruling on a separate lawsuit claiming that it is discriminatory for Jeju Island to issue a conditional permit banning the hospital from providing medical services to domestic customers until the results of the permit cancellation lawsuit will be confirmed.

The province gave Greenland Group permission to establish the Greenland International Medical Center in December 2018, but on the condition that only foreigners can be treated. The permit was canceled in April last year after the hospital did not meet the opening deadline.

재판부는 판결문에서
원고인 녹지그룹이
제주도의 조건부 허가에 위법성을 주장하며 소송을 진행하더라도
개설 허가에 공정력이 있는 이상
3개월 이내에 업무를 시작해야 하며
이를 무단으로 거부한 것은
개설 허가 취소 대상이라고 판시했습니다.

다만 내국인 진료를 금지한 조건부 허가가 부당하다는
취소 소송에 대해서는
개설 허가 취소와 관련한
판결이 확정될 때 까지 선고를 연기한다고 밝혔습니다.

한편, 제주도는
지난 2018년 12월 녹지국제병원이
외국인만 진료하는 조건으로 설립 허가를 내줬는데
병원측이
기한 내에 문을 열지 않자 지난해 4월 허가를 취소했습니다.
