Transfers Allowed for Urban Graves

In accordance with the Act on Special Measures for the Registration of Real Estate, burial sites in dong-administrative districts will also be allowed to have its ownership transferred, including rural areas.

The National Assembly has recently passed the revision bill
of the Act on Special Measures
for the Registration of Real Estate.

The revision bill allows to register ownership
of real estates of which the right of ownership cannot be exerted,
to help ease the process and support successful completion of transfers.

The Act has been applied for all lands and buildings in rural areas,
but in dong-administrative districts, the act has been applied
for farmlands and forests, excluding cemeteries.

In Jeju, registered graveyards account for
8.4% of lands with 72,000 lots led by
traditional local customs.



동(洞) 지역 묘지도 부동산 이전등기 가능

앞으로 동 지역의 묘지도 읍면지역과 마찬가지로
부동산 특별조치법의 적용을 받아 이전 등기가 가능해 집니다.

국회는 최근 이같은 내용의 부동산 소유권 이전등기 특별조치법 개정안을 의결했습니다.

특별조치법은 소유권 이전등기가 제대로 이뤄지지 않아 재산권을 행사하지 못하는 부동산에 대해
간편한 절차에 따라 등기할 수 있는 제도입니다.

하지만 현재 읍면 지역은 모든 토지와 건물에 대해 조치법이 적용됐지만
동 지역은 묘지 부분을 제외한 농지와 임야로 한정돼 형평성 문제가 제기돼 왔습니다.

제주의 경우 특유의 매장품속과 산담문화로
지적공부에 등록된 묘지가 전체 필지의 8.4%, 7만 2천여곳에 이르고 있습니다.
