Criminal Compensation for the Missing

Mr. (김필문) Kim Pil-mun, 75, has finally felt some small sense of calm and relief from a pain that has haunted him nearly his entire life.
He was three years old when the April 3rd Incident broke out.


It was then that soldiers stormed his house and arrested his father for rebellion and violation of the Defense Security Act. He was sentenced to 15 years in prison in (대구) Daegu, at which point he simply went missing.


Mr. Kim filed a reconsideration bill to restore his father's honor, and in response to this, his father was acquitted of all charges last year by the Jeju District Court. The retrial came 72 years after his original arrest.
Based on the acquittal, Mr. Kim then filed a criminal compensation suit, and won the case.

I'm grateful that my 74-year-old pain was somewhat relieved by the state and that I was compensated, but it was also delayed for far too long.


335 prisoners who were wrongfully convicted, imprisoned, and then went missing during the April 3rd Incident were acquitted at retrials in March last year.
Among them, 8 filed criminal compensation suits against the state, and won.
This was the first such ruling by a court for compensation for bereaved families.


Jang Chan-soo, a senior judge of the second criminal department of the Jeju District Court, ruled that heirs can claim compensation if a convicted prisoner was found to have been illegally detained and has since passed away.


The court decided to pay the maximum amount of criminal compensation allowed by law, considering property losses, mental pain, physical hurt during illegal detention, and the long road that the bereaved families have had to take for these retrials due to the state's lack of action.


As a result of the judge's decision, the eight plaintiffs will receive compensation of between 20 and 200 million won, calculated by multiplying a daily rate of 348,800 won for wrongful imprisonment by the number of days of detention.

We may have won this case to receive criminal compensation, but we are only eight out of the hundreds of bereaved families. We feel for all the other families, and hope that they too will one day share this feeling.


Following previous compensation given for surviving prisoners, criminal compensation for missing prisoners has now been made.
This recent ruling is expected to lend momentum to the remaining legal processes needed to compensate wrongfully detained prisoners.

자격 미달인 응시자를 합격시킨 사실이 확인됐습니다.


응시 자격이 연구 경력 5년 이상이었음에도
경력이 2개월 부족한 응시자가
다른 후보들을 제치고 최종 합격한 겁니다.


감사위는
서류전형에서 탈락했어야 할 응시자가
필기와 면접을 거쳐 부당하게 임용되는 등
직원 채용의 공정성과 객관성이 훼손됐다며
담당자를 중징계 처분하라고 요구했습니다.


제주경제통상진흥원은
응시자와
이해관계가 있는 자를
시험위원으로 위촉했다가 적발됐습니다.


진흥원에서 근무했던
전 직원 2명이 공채에 응시했는데
이들과 같은 부서에서 일했던 동료를
시험위원으로 두고 심사하게 했습니다.


감사위는
응시자의 이해관계자가 시험위원으로 위촉돼
면접시험이 특정인에게
유리하게 진행됐을 우려가 있다며
담당자를 징계 문책하도록 했습니다.


또 4.3평화재단은
블라인드 채용 가이드라인을 위반해
응시자의 증명사진과 세대주 성명 등
인적사항을 부당하게 요구했다가 주의 조치를 받았습니다.


도내 공공기관의 채용비리가 근절되기는 커녕
감사위원회의
감사 때마다 계속해서 터져 나오면서
강력한 후속조치가 뒤따라야 한다는 지적입니다.
