Court says province’s refusal of building permit ‘acceptable’
Citizen had sought to overturn province’s decision regarding Udo construction
A court has ruled in favor of limiting development on the small island of Udo in order to preserve its natural environment and prevent overdevelopment.
Jeju District Court Administrative Judge Heo Myung-ok ruled against the plaintiff in the case, someone known only by the surname “Yoon.” The provincial government had rejected a building permit for Yoon, saying the proposed house was “unsuitable” with the forest zone in which he planned to build. Yoon had filed suit to get that decision overturned.
The court said that just a one-floor house would have a negative impact on the natural surroundings and that it could prompt more people to seek building permits. The court ruled the provincial government’s refusal of the building permit was reasonable and within the realm of its authority.

우도의 자연경관 보존과 난개발 방지를 위해 해안가 인근에 단독주택 건축을 불허한 제주도의 처분이 타당하다는 법원의 판결이 나왔습니다.
제주지방법원 행정부 허명욱 부장판사는 윤 모씨가 제주시 우도면 임야에 단독주택을 짓게 해달라며 제주도를 상대로 제기한 건축허가 신청 불가처분 취소 청구 소송에서 원고 패소 판결을 내렸습니다.
법원은 해당 토지에 1층 규모의 단독주택을 건축한다 하더라도 주변 경관에 미치는 영향일 클 것으로 보이고 유사한 신청이 속출할 것으로 보여 난개발이 우려된다며
제주도의 처분이 재량권을 남용했다고 볼 수 없다고 설명했습니다.
