Berjaya sues JDC
Developer says center breached land sales conditions in contract
The developer of the (예래) Yerae Resort-type Residential Complex is suing the Jeju Free International City Development Center.
In a statement to Bursa Malaysia on Friday, the Berjaya Group said its subsidiary Berjaya Jeju Resort was seeking to recoup losses and damages from the JDC, claiming it breached the terms and conditions the two sides agreed to in 2009 when land for the resort was purchased. According to the agreement, the JDC was obligated to transfer the plots to Berjaya free from all quote “liens, security interests and encumbrances" unquote.
But construction was suspended earlier this year after the Supreme Court declared invalid the expropriation by JDC of certain plots of land which were sold to Berjaya. This led to the former landowners filing a suit demanding that their property be returned.
Berjaya plans to seek further legal advice as it navigates future proceedings in the lawsuit.

예래휴양형주거단지 사업자인 버자야랜드버하드는 지난 6일, 말레이시아 증권거래소를 통해 소송을 제기한다고 공시했고 서울지방법원에 소송을 제기한 것으로 알려졌습니다.
버자야는 대법원 판결 이후 수개월째 공사가 중단되면서 지난 2009년 계약한 토지소유권 이전도 불가능해졌고 사업파트너인 JDC는 이에 대해 뚜렷한 대응책을 내놓지 못하고 있다며 소 제기 이유를 밝혔습니다.
버자야는 법률 자문을 거친 뒤 계약 위반과 손해보상 등의 법적 절차를 진행할 계획입니다.
