Supreme Court annuls lower court’s ruling on Samdasoo
Injunction on JPDC’s decision to seek new distributor thrown out

The legal battle between the provincial government and food giant Nongshim over the sales rights for Samdasoo bottled water is back to square one.

The Supreme Court on Sunday reversed a lower court ruling that sided with Nongshim… saying it was possible the company may not have met the requirements to continue selling Samdasoo, and that there was a need to reexamine the case from the beginning.

In late 2011, the Jeju Special Self-Governing Province Development Corporation, which bottles the water, decided to terminate its retail contract with Nongshim after 14 years and receive bids from other firms to distribute the bottled water.

Nongshim filed for and received an injunction against JPDC’s process to select a new Samdasoo distributor. That’s the decision that the Supreme Court has now annulled.

대법원, 道-농심 삼다수 분쟁 '파기환송'

삼다수 판매권을 놓고 벌인 제주도와 농심의 법적 다툼이 원점으로 돌아갔습니다.

대법원 1부는 농심이 제주도를 상대로 제기한 이른바 '삼다수 조례' 무효확인 소송 상고심에서 원고 승소 판결한 원심을 파기하고 사건을 광주고법으로 돌려 보냈습니다.

재판부는 농심이 자동연장조건을 충족하지 못해 판매사업자 지위를 상실했을 가능성이 큼으로 원심이 좀 더 심리할 필요가 있다고 밝혔습니다.

한편 제주도는 지난 2011년 12월 농심의 '제주 삼다수' 판매권 독점에 대한 지적이 제기되자
조례 개정을 통해 기존 수의계약 방식을 일반입찰로 바꾸고 부칙으로 농심의 삼다수 판매사업자 지위를 2012년 3월까지만 인정하도록 했습니다.
