‘Protest in front of apartment is invasion of privacy’
Case involves CEO of Yeomiji Botanical Gardens

Laborers have protested in front of the Yeomiji Botanical Gardens’ CEO’s apartment building for what they called the unfair firing of a fellow worker, but Jeju District Court has ruled that doing so is an invasion of privacy.

Judge Heo Ilseung (허일승) said the shared apartment building had no connection to Yeomiji, and that the protests could be seen as an invasion of privacy for the other residents. He ordered the Jeju Branch of the Korean Confederation of Trade Unions to stay at least 100 meters away from the boundary of the apartment building in question.

제주지법 "아파트 앞 시위는 사생활 침해"

여미지식물원 노동자 부당해고 분쟁과 관련해 사측 대표가 거주하는 아파트 앞에서 집회나 시위를 하는 것은 사생활 침해에 해당한다는 법원의 판단이 나왔습니다.

제주지방법원 제3민사부 허일승 부장판사는 여미지식물원 운영 업체 대표 A씨 부부가 민주노총 제주지역본부 등을 상대로 제기한 집회금지 등 가처분 신청을 받아들였습니다.

법원은 해당 아파트는 쟁의행위가 발생한 여미지식물원과 연관이 없고
A씨 부부와 이웃 주민들의 사생활의 자유를 침해할 우려가 있다며
아파트 경계 100m 이내에서의 집회.시위를 중단할 것을 주문했습니다.
