Court rules against Jeju Air
Judge sides with province in saying fare increase was ‘unjustified’

A court has ruled that Jeju Air was unjustified in raising ticket prices because it had not first discussed the plan with the provincial government.

A Jeju civil affairs division of the Gwangju High Court annulled a lower court’s decision in the case in favor of the airline and granted an injunction request by the province.

The judge ruled that the fare increase damaged the public interest but that it in no way negatively affected the airline.

If this ruling is finalized, Jeju Air will be barred from raising ticket prices. It will be required to pay the province ten million won for every day not in compliance with that rule.

법원, 제주항공 요금인상 '부당'

제주항공이 제주도와 사전협의도 없이 요금을 인상한 것은 부당하다는 법원 판결이 나왔습니다.

광주고등법원 제주 제1민사부는 제주도가 제주항공을 상대로 제기한 항공요금 인상금지 가처분 항고심에서 원심을 파기하고 가처분 신청을 인용했습니다.

재판부는 판결문을 통해 제주항공이 요금을 인상하면 공익적 목적이 훼손되는 손해가 발생하는 반면, 항공사에는 손해가 발생한다고 보기 어렵다고 판시했습니다.

이에 따라 이번 판결이 최종 확정되면 제주항공은 종전요금을 초과한 요금을 부과할 수 없고 이를 위반할 경우 하루에 1천만 원씩을 제주도에 지급해야 합니다.
