Landowners lose appeal in expropriation case
Gwangju High Court rejects arguments regarding Jeju Shinhwa World

Former landowners where Jeju Shinhwa World is now located have lost their court case against the government for its expropriation of their properties for the project.

Seven former owners of land in Andeok-myeon had appealed a lower court’s ruling in favor of the provincial government and the land expropriation committee. The Gwangju High Court’s first administrative division dismissed the suit.

In explaining its decision, the court said the expropriation for Jeju Shinhwa World may limit to some degree landowners’ accessibility and availability, but it also determined that that was not in conflict with the nature of an amusement park.

제주신화역사공원 부지의 원 토지주들이 토지 강제수용에 반발해 제주도를 상대로
행정소송을 냈지만 항소심에서도 패소했습니다.

광주고등법원 제주제1행정부는 서귀포시 안덕면 토지주 7명이 제주도와 제주도 지방토지수용위원회를 상대로 낸 수용 재결 취소소송 항소심에서 원고의 청구를 기각했습니다.

법원은 신화역사공원이 도민에 대한 접근가능성과 이용가능성을 일부 제한할 수 있지만 유원지 본질을 훼손하지는 않는다며 기각 이류를 설명했습니다.
