Employment Aging Act stipulates retirement at age 60

The Gwangju High Court's Jeju First Civil Affairs Division ruled that it is illegal for the province to set the retirement age of local street cleaners at age 58 based on a provisory clause in the collective agreement signed with the contracted labor union.

The court rejected the local government’s appeal against the six local street cleaners’ appellate trial with Governor Won Hee-ryong and admitted the plaintiffs’ claim.

Officials set the retirement age of the contracted labor union members subject to the progressive retirement pay at 58 years old in a collective agreement signed in 2013. The court dismissed the agreement because it violated the Employment Promotion for the Aged Act and confirmed the worker’s retirement at age 60.

법원 "환경미화원 만 58세 정년 단서조항은 위법"

제주도가 단체협약의 단서조항을 근거로
일부 환경미화원들의 정년을
만 58세로 정한 것은 무효라는 법원 판결이 나왔습니다.

광주고등법원 제주 제1민사부는
도내 환경미화원 6명이
제주도지사를 상대로 제기한 항소심에서
제주도의 항소를 기각하고,
미화원들의 청구를 인용했습니다.

제주도는 2013년
무기계약직 노조와 체결한 단체협약에서
퇴직누진제를 적용받는 조합원의 정년을 만 58세로 정했는데,

재판부는 고령자고용법에 위반돼 무효라고 판시하며
이들의 정년을 만 60세로 확인한다고 밝혔습니다.
