8 prisoners of the 4.3 Incident receives retrial
First general case to be retried

Survivors of unfair imprisonment during the 4.3 Incident will get the chance to make an appeal in court for the first time in more than 70 years.

Jang Chan-soo (장찬수), the senior judge at the Jeju District Court, decided on Thursday to re-examine the cases of former prisoners, including 96-year-old Song Soon-hee (송순희).

Notably, the case of 93-year-old Kim Doo-hwang (김두황) will be retried, the first general trial among the 4.3 Incident cases to be re-examined. The other seven cases were military trials.

The court explained its decision to reopen the case by pointing out that Kim's detention period exceeded 40 days, an indication of illegal detention. The court also noted that his testimony was credible.

4.3당시 억울한 옥살이를 한 생존 수형인들이
70여 년 만에 정식재판을 받게 됐습니다.

제주지방법원 제2형사부 장찬수 부장판사는
8일 96살 송순희 할머니 등 7명에 대한 재심 청구 사건에 대해
재심개시 결정을 내렸습니다.

특히 93살 김두황 할아버지에 대해서도 재심개시 결정을 내려
첫 일반재판에 의한 생존수형인 재심이 이뤄지게 됐습니다.

재판부는 김 할아버지 건에 대해
구금 기간이 40일을 초과한 것만 봐도 불법구금이 확인되는 등
진술에 신빙성이 있다고 본다며 재심개시 결정 이유를 설명했습니다.
